Introduction:
By using our website, placing an order, or engaging our services, you agree to comply with the following Terms & Conditions. These terms govern your use of our website, services, and products. Please note that Magnolia Cakery reserves the right to amend or update these Terms & Conditions as necessary. Any updates will be published on our website.
Payments and Deposits:
To confirm your order, Magnolia Couture Cakery requires:
Wedding Cakes: A 30% non-refundable booking fee
Celebration Cakes: A $150 non-refundable booking fee
Payment of the booking fee secures your date and signifies acceptance of these Terms & Conditions.
Wedding Cakes: The remaining balance is due one month before the delivery or collection date.
Celebration Cakes: Balances may be paid seven days before the Event.
Failure to pay the balance by the due date will result in cancellation of your order, and the booking fee will be forfeited.
For rental equipment, deposits vary and are clearly stated on your order form. All rented items must be returned in their original condition within 7 days of your event to receive a full deposit refund.
Design:
At Magnolia Cakery, each cake is a handcrafted creation made with care and artistry. We will always strive to bring your chosen design to life with precision; however, slight adjustments may be necessary to ensure the design complements the cake’s structure and presentation. Please note that all cakes are handmade, and as such, subtle variations in colour, texture, or overall appearance may occur. Photographs provided by clients will be used as inspiration, but the final design may differ. Colour swatches will be matched as closely as possible; however, subtle variations may sometimes be unavoidable.
If you wish to amend your design, please notify us as early as possible so we can accommodate your request:
Celebration Cakes: Design changes may be made up to 7 days before collection.
Wedding Cakes: Design changes may be made up to one month prior to the delivery date.
Any amendments may affect the final cost. A revised order form will be prepared and must be approved and signed at least one month prior to the delivery date. After this point, further changes will incur an additional fee. Magnolia Cakery reserves the right to make design modifications if circumstances beyond our control, such as weather or environmental conditions, could compromise the quality of the finished cake. In such cases, clients will be notified, and every effort will be made to keep adjustments minimal while maintaining the integrity and beauty of the design.
Non-Edible Decorations and Materials:
If you choose to incorporate fresh flowers supplied by your florist or another vendor, Magnolia Cakery will provide flower picks upon request. Please note that fresh flowers are not a food product and may carry natural elements such as pesticides, insects, or dirt. It is essential that your florist selects blooms suitable for cake placement and ensures they are non-toxic. Magnolia Cakery cannot accept responsibility for flowers placed directly into the cake or for any contaminants they may carry.
For your guests’ safety, please remove all non-edible elements, including support dowels, flower picks, wired florals, ribbons, and lace, before the cake is cut and served.
Allergy & Ingredient Disclaimer
Our products may contain nuts, gluten, dairy, eggs, soy, and other allergens. While we take precautions, we cannot guarantee that products are completely allergen-free. Please notify us of any known allergies before placing your order. Of course, we can accommodate some dietary restrictions, but not all of them.
Delivery & Pickup Policy
Delivery: Fees and areas served will be communicated at the time of order.
Responsibility: Magnolia Couture Cakery is not liable for damage occurring after delivery or during transit by third parties.
Pickup: Cakes must be picked up at the scheduled time. Magnolia Cakery is not responsible for cakes left outside the designated pickup windows.
Refunds and Cancellation:
All booking fees for cake orders are non-refundable, as they secure your date and cover any preliminary work, including design preparation and ordering of supplies. Booking fees are also non-transferable, unless otherwise agreed by Magnolia Cakery and subject to availability.
If you wish to cancel your order, please notify us in writing at info@magnoliacakery.ca.
Wedding Cakes: Orders cancelled within one month of the delivery date are non-refundable.
In the rare and unforeseen event that Magnolia Cakery must cancel your order, we will provide as much notice as possible and work with you to arrange a suitable alternative. If an alternative is not acceptable, a full refund will be issued. Please note that Magnolia Cakery cannot be held liable for any additional costs incurred as a result of such cancellation.
Intellectual Property & Copyright
All photographs, cake designs, written content, and the Magnolia Couture Cakery logo are the property of Magnolia Couture Cakery. Unauthorized use or reproduction is prohibited.
Clients may share images of cakes for personal use on social media, provided they credit Magnolia Couture Cakery.
Commercial use of designs, photos, or branding without written consent is strictly forbidden.
Liability & Indemnification
Magnolia Cakery is not liable for indirect or consequential damages resulting from the use of its products.
Clients agree to indemnify and hold Magnolia Cakery harmless for misuse, mishandling, or modification of cakes after delivery/pickup.
Force Majeure
Magnolia Cakery is not liable for delays or failures in performance due to events outside our control, including but not limited to natural disasters, power outages, pandemics, or transportation disruptions.
Photography & Social Media
Magnolia Cakery may use photos of cakes for marketing purposes, including social media and website content.
Clients may request to opt out by notifying us in writing prior to the delivery date.
Website Content & Privacy Policy
Magnolia Cakery strives for accuracy in pricing, availability, and information; however, we cannot guarantee that all website content is current.
Privacy Policy: We collect personal information (name, email, phone number, order details) to process orders and respond to inquiries. We do not sell or share information with third parties except where required by law. By using our website, you consent to our collection and use of your data.
Modification of Terms
Magnolia Cakery reserves the right to update or modify these Terms & Conditions, Privacy Policy, and related policies at any time without prior notice. The latest version will always be posted on our website.
